What Are The Repercussions Of Firing My Realtor - Realtor.com

Q: My realtor is not as aggressive as I need her to be. My house has been on the market a month and she has not done an open house or listed the home in any newspapers.I made it clear to her that my job was forcing me to move in 60 days and needed her to sell it as quickly as possible. It took her a full week to list the home online and put a sign in the yard. I did not sign the exclusive right to sell contract because the listing price she put was wrong. I did sign the Agency Disclosure Statement, Consumer Guide to Agency Relationships, Fair Housing, and Seller Disclosure of Property Condition. I would like to know if I can fire her and get a new realtor without any repercussions or having to pay her anything.

A: Because you have a written agreement in place, your current agent can legally pursue his/her side of the commission even if you decide to do business with another agent. Try speaking with this agent and being honest about your feelings towards the way she?s handled the situation. If you ultimately don?t want to work with her, chances are she may very well do a 360 and service you better. Communication and clarification could prevent legal disputes, stress and unnecessary time. Many agents opt out of a listing and cancel their agreements voluntarily with the Seller over working with someone who isn?t happy with them. You?d be surprised what a simple, candid conversation can accomplish.

A: The short answer is Yes, if you don?t actually have a signed listing agreement with her. The long answer is still Yes, but I would take an extra step before firing her. Call the managing broker for your agent?s office and explain what the issues are. I can?t imagine that the Broker would not have a problem with how the agent is handling the listing especially since you don?t have a signed listing agreement. Ask her if you can change Realtors within the company and explain exactly what your expectations are with the next Realtor. If you can?t work it out with that Broker and you find a different company to work with, please make sure that you explain that you are highly motivated and be ready & willing to listen to their suggestions regarding price & quick fixes to make the house show as well as possible. Ask them to provide you with a marketing plan, this way you will know what they plan on doing to market your house. It is very possible that what you think is good marketing is not as effective as other types of marketing. For example, you mentioned Open Houses and ads in a newspaper. In my primary market, we do not use newspaper ads very often because most buyers use the internet now to search properties, not the newspaper. Good Luck!

A: Have you actually approached your listing agent with your concerns? First do that. 2nd.?There is a misnomer among sellers re: open houses?.. While on occasion a buyer will come into an open house and make a successful bid, open houses are for the listing agents to gain new clients and leads. Granted there are some areas and price range of homes where open houses may generate more traffic and thus increase possible buyers for a home but typically speaking open houses is a lead generation for listing agent. 3rd -If speaking directly to the listing agent does not work, speak to the agents broker 4th- You may need to contact an attorney if the above does not work and have the attorney review the contract you signed.

The Dog Bite Defense and Your FCPA Compliance Program ...

As most readers of this blog know, I am a recovering trial lawyer. I almost always acted as defense counsel for corporations in my trial lawyer career. In the trial lawyer world, there are four recognized defenses to any claim which are affectionately known as the ?Dog Bite Defenses?. They are:

  1. My dog didn?t bite you.
  2. Even if my dog did bite you, it?s because you provoked him.
  3. Even if my dog did bite you, you really aren?t injured.
  4. My dog didn?t bite you because I don?t have a dog.

The fourth version of the Dog Bite defense is certainly an ?all-in? move. You had either (1) better be right or (2) have some big kahunas to make that argument to a jury with a straight face.

None of the cases I defended involved allegations of violations of the Foreign Corrupt Practices Act (FCPA) but some did involve corporate fraud. In an article entitled ?Business Ethics and Moral Motivation: A Criminological Perspective? Joseph Heath took a look at the prevalence of white-collar crime in the discussions in business ethics. In his abstract he stated that ?One of the effects that has been the development of a strong emphasis upon questions of moral motivation within the field. Often in business ethics, there is no real dispute about the content of our moral obligations, the question is rather how to motivate people to respect them. This is a question that has been studied quite extensively by criminologists as well, yet their research has had little impact on the reflections of business ethicists.? In this article, I attempt to show how a criminological perspective can help to illuminate some traditional questions in business ethics. I begin by explaining why criminologists reject three of the most popular folk theories of criminal motivation. I go on to discuss a more satisfactory theory, involving the so-called ??techniques of neutralization,?? and its implications for business ethics.

In a post entitled ?A Criminological Perspective on Business Ethics? my fellow cyclist and blogging colleague Doug Cornelius reviewed Heath?s work. He noted that Heath began with the premise that the ethics scandals in the early years of the twenty-first century were not a business ethics failures but were really high-level, large-scale white collar crime. While the actions of the senior management of Enron, WorldCom and Adelphia were certainly illegal acts, these acts were probably surrounded by unethical conduct. However, the core actions all involved a failure to comply with the law.

What interested me about Heath?s article was that large corporations seem to generate a very steady stream of rather plausible (or plausible-sounding) excuses for misconduct. He believed that this ?is the result of a confluence of factors: first, corporations are typically large, impersonal bureaucracies; second, the market allows individuals to act only on the basis of local information, leaving them in many cases unaware of the full consequences of their actions; third, widespread ideological hostility to government, and to regulation of the market in particular, results in diminished respect for the law; and finally, the fact that firms are engaged in adversarial (or competitive) interactions gives them broader license to adopt what would otherwise be regarded as anti-social strategies.? Doug summarized these in his post which I cite in their entirety:

Denial of responsibility

The offender claims that conditions of responsible agency were not met: it was unintentional; he was insane, he was provoked, he had ??no choice?? but to do it, it was all an accident, etc. In a company, an employee can blame his boss for telling him to do something wrong. The boss can pass the blame back down to the worker saying they acted independently.? The competitiveness of the marketplace and the workplace means that if one individual refuses to perform an illegal act, he may feel that he could simply be replaced by someone else who would.

Denial of injury

The offender seeks to minimize or deny the harm done. Most white collar criminals never meet or interact with those they harmed.? In many cases they wouldn?t even know how to find their victims.? ?In these cases, there is potential confusion as to the identity of the individuals who are harmed by the criminal?s actions. In other cases, the mere fact that there is diffusion of the harm over a very large number of persons is appealed to as grounds for denial that anyone was injured by the person?s actions.?

Denial of the victim

The offender acknowledges the injury, but claims that the victim is unworthy of concern because he deserved it. The underpayment inequity is common. It?s hard to find an employee who believes that an enhancement of?justice in society would require a reduction of his compensation package. On the other hand workers may feel under compensated, ignoring the difference between the ease with which they can be replaced that determines their wage rate, and their contribution to the company. It is really easy for workers to convince themselves that they are not stealing. Instead they believe they taking what they are owed, or?they are punishing the company for treating employees poorly.

Condemnation of the condemners

The offender attempts to ??turn back?? the charges by impugning the motives of those who condemn his actions. The classic examples in corporate crime are the charges fired back at Eliot Spitzer during his time as Attorney General when he exposed a wide range of?practices in the financial services industry. His political ambitions were often discussed side-by-side with his prosecutions.

Appeal to higher loyalties

The offender claims that the action was done out of obedience to some moral obligation that conflicted with the law. You often hear ?I did it for my family.? The offender can see the company as a proxy and serve as an object of higher loyalty. One theory with Ken Lay and Jeffrey Skilling at Enron is that they misled investors for the sake of the company, insisting that it was a great company. There is also the more common business ethics excuse that it was done for profit and the benefit of the shareholders.

Everyone else is doing it

The mere fact that others are breaking the law is used to suggest that it is unreasonable for society to expect compliance. This is an excuse for all kinds of crime, but it is very common in a business context because of the competitiveness of the business environment.

Claim to entitlement

An offender claims he was acting ??within his rights?? and that the legal prohibition of his conduct constituted unjust or unnecessary interference. One of the big differences between corporate crime and street crime is how often white collar criminals deny the authority of the laws that they have broken. The argument is that the government should not regulate certain forms of private transactions.

Folk Tales of Moral Motivation

Heath argues that the focus on these techniques of neutralization is more effective in addressing business ethics and corporate crime than theories of ?moral motivation.? The field of criminology has largely discredited those theories as folk tales. It?s not about character, greed, and values.

Another colleague has summarized these defenses along with some others that he has heard over the years into the following ?Employee Defenses?. They certainly more fully expand on the Dog Bite defenses that I used, or rather, that I heard other defense lawyers were forced to use, in defending cases.

  1. ?I didn?t do it
  2. ?I didn?t do it, but that other guy did
  3. ?I did it, but everyone else is doing it
  4. ?I did it, but my supervisor knew about it
  5. ?I did it, but my supervisor told me to do it
  6. ?I did it, but there is no rule that says not to do it
  7. ?I did it, but I did not know it was against the rules
  8. ?I did it, but that particular rule doesn?t apply in this case
  9. ?I did it, it was against the rules, but the rules are unreasonable
  10. ?I did it, it was against the rules, but they have not been consistently enforced
  11. ?I did it, its a reasonable rule, consistently enforced, but the penalty is too severe
  12. ?I did it, but if I file a complaint, it?s retaliation if you enforce the reasonable and consistently applied rule
  13. ?Who are you again?? (And back to #1)

What does all this mean for a compliance practitioner? First, it speaks to the need to be ever vigilant in your overall FCPA or UK Bribery Act compliance regime. You must work towards both the prevention and detection prongs of McNulty?s Maxims. The pack mentality is part of what makes a corporation succeed so you must make clear that there will be no tolerance for retaliation against whistleblowers (as in ? they are not ?team players?). Lastly, when you begin any internal investigation, you need to be prepared for these defenses; whether they are the straight-forward four Dog Bite defenses, Heath?s list of justifications as summarized by Cornelius or the 13 point formula of employee defenses.

Jason Friedland is the Director of Operations and Investments for Iron Stone. He has over 10 years of experience as a developer in commercial and residential real estate projects, with a focus on acquisition, construction management, financing, zoning, historic tax credits, and portfolio and asset management. He is the co-sponsor of Falls Center, the 800,000 square foot redevelopment of MCP Hospital, one of the largest active historic redevelopments in the Northeastern United States. Since 2008, in his capacity as Director of Operations for Iron Stone Real Estate Fund II, Jason has helped negotiate and acquire more than 15 non-performing commercial mortgage liens from financial institutions.

Q: How did you get your start in the real estate business??

It was originally my wife?s idea.? In 2002, having just moved to Philly, I was exploring opportunities in several different industries, but real estate was not on the list.? However, I became enamored with the historic and organic nature of Philly?s urban landscape and would spend my free time exploring the city?s neighborhoods.? It was more of a hobby than anything else, and she suggested I pursue real estate professionally.

Q: What is your favorite part of your job? What is your least favorite?

?I would say I enjoy 90% of my job.? Every day is a different adventure.? I have had the pleasure of collaborating with my two business partners, Matthew Canno and Andrew Eisenstein, for more than 10 years.? Some of my favorite aspects include creating the structure and execution strategy for new acquisitions.? Also, I thrive on working with our team members in a positive and supportive office environment.? No surprise here, but I would say that the constantly increasing accounting, regulatory and audit requirements for our funds are my least favorite aspect of the work week. ??????

Q: How have economic conditions affected Iron Stone?s investment strategies? Has your focus widened or narrowed due to present market conditions??

Our investment strategy has not changed much over the past 12 years.? We remain committed to opportunistic investments that actually underwrite and make financial sense.? If they do not pencil out, we pass.? Every investment must have a discernible exit strategy from the beginning and for that reason we look at everything, and bid on much less. ?This ability to rapidly adapt and remain highly sensitive to changes in the market has really helped us realize value from our investments. ?We completed our 100th project a few years ago, and our expertise encompasses nearly all real estate asset classes.? For that reason we have expanded our scope to about a 100-mile radius from our headquarters, with the majority of our investments targeted for the city and near suburbs.

Q: You work with a wide variety of property types. Since the recession began, have any of these asset types surprised you with their performance (for better or worse)? ?

In 2009 and 2010, we purchased the underlying debt on 15 apartment buildings that had been overleveraged and severely neglected.? The sellers included Capital One and CitiBank among others?? During the recession we felt that if we could improve the buildings to provide secure, clean, renovated apartments, we would be able to rent them regardless of the doldrums of the economy, and our instincts have proven correct.? That said, now the multi-family sector is extremely competitive and we have targeted other asset classes that we believe are being overlooked by investors and lenders.

Q: Is green technology impacting your investment decisions? Do you think it is a good strategy economically? Why/why not??

We pursue redevelopment strategies that make financial sense, so our model of adaptive reuse is inherently ?green.?? For example, at Falls Center, the former MCP Hospital, we have been successful in recycling 90% of construction materials during demolition, and we used soy-based insulation instead of traditional materials because it was faster to apply and effectively provided an unbroken blanket of insulation.? While the material was more costly per square foot, the labor savings gained from faster application of the soy product made more financial sense.? Similarly, to reduce electricity consumption, we have converted the majority of our light fixtures at our apartment buildings to LEDs and have noticed about a 50% increase in efficiency.? Also, we recently converted a few of our apartment buildings to use solar hot water systems.

Q: You have experience investing in and repurposing historic properties. What challenges do such properties present? What opportunities?

I have to begin this by saying that the weak demand for commercial and multi-use space is by far the biggest challenge to redevelopment in Philadelphia. We have repositioned more than one million square feet of functionally obsolete buildings and without the underlying users and tenants, our redevelopment business would be dead in the water.? Looking specifically at historic properties though, we face the added challenge of constructing within increasingly restrictive historic preservation standards.? The guidelines require a lot of attention and need to be effectively communicated to every person working on the project to make sure that the whole team understands what to save. Despite these challenges, the opportunity to save and incorporate existing features into the new building design?instead of gutting the building wall to wall?helps us maximize efficiency and preserve important elements at the same time.? This approach takes a tremendous amount of time in the planning stage, but the savings are well worth it.

Q: In what ways do you imagine the industry will be different 5 years from now? 10 years?

I?m hopeful that increased demand for space will make obsolete and vacant industrial buildings throughout the city more financially viable to put back in service.? I?m also excited for engineering breakthroughs in building materials that will make older buildings even more cost efficient to renovate.???

Q: If you didn?t work in the Mid-Atlantic market, what region would you be interested in exploring? Why??

I?m only interested in investing in markets that I understand, so that would limit me to the Mid-Atlantic region and my home state of Colorado.

Q: What is the most interesting or challenging component of your job??

For me, the most interesting part of the job is helping tenants figure out their space and programmatic needs while also learning about their businesses.? Managing the growth of our company is also challenging but a lot of fun at the same time.

Q: Assuming you are able to get time off this year, what vacation destination would you like to visit in 2012??What about this destination is so appealing to you?

It?s already planned.? I am spending my 10th wedding anniversary in Montenegro. It?s off the beaten path and devoid of cell phone service.

Windows 8 will bring out some variety in Toshiba laptop line, with announcements including a ?laptablet? with sliding keyboard, a super wide notebook with a 21:9 aspect ratio, and more Ultrabooks.

Toshiba has shown that it?s prepared for Windows 8 by revealing five launch products. The most revolutionary of these is the Satellite U925t ?laptablet,? which we?ve already had hands-on time with, but the company has also announced four other products.

Toshiba Satellite U845W widescreen laptopOne is a familiar but unusual sight ? the Satellite U845W. Toshiba?s ultra-wide laptop will be largely the same as before. It will have the same 1792 x 768 display and the same internal hardware. Toshiba claims it makes a particularly good laptop for Windows 8 because of its extra-wide display and large touchpad with Windows 8 gesture support.

It will pack a 14-inch display, low-voltage Intel Core processors and a 32GB solid state drive backed up by a 500GB mechanical unit. Thickness comes in at .78 inches and weight is a bit under four pounds. As with the U845W, the U945 will have full Windows 8 gesture support.

Another new laptop in the pipe is the Satellite P845t. This 14-inch model is not an Ultrabook, but a standard multimedia laptop. As such, it offers a Core i5 processor instead of a slower, low-voltage version. Other features include Windows 8 gesture support, a 750GB hard drive and Harman/Kardon stereo speakers.

This new entry will compete head-to-head with HP?s TouchSmart and Lenovo?s IdeaCentre all-in-ones.

All of these new products will be hitting store shelves the day Windows 8 launches ? October 26. Pricing is unannounced.

Bruce Buffer explains ?It?s fight time?

During recent UFC events, you may have noticed UFC Octagon announcer Bruce Buffer changing up his signature call of, "It's tiiiiiiiiiime" to "It's fight tiiiiiiiiiiiiiiiime."

I was confused by this. Why would Buffer mess with such announcing perfection? "It's time" is so well known that fans usually yell the phrase along with him. It's become as well known as his brother Michael Buffer's familiar "Let's get ready to rumble," which the other Buff rattles off at boxing events.

So what's the deal, Buff?

"I was trying some new things. I'm going through some marketing aspects, and that's all I can say right now. I wanted to try it for marketing purposes, but it's time is mine. We all know that. That's basically where it's at."

Buff, if you want to cover your fancy suits in logos, go for it. If you want to rename your signature move the Mickey's Malt Liquor 180, do it. Get that paper. But please please please don't change "It's Time."

8 Principles of Preparing for Retirement ? Part 3

This week we finish up the principles for achieving financial independence (see Part 1 and Part 2). Most people will never achieve financial independence. According to the Social Security Administration, 55% of people drawing benefits have no other income and savings of less than $25,000. This is a sad statistic considering Social Security was only designed to supplement a person?s income in retirement.

Principle 6: Build a New Three-Legged Stool?.

Anyone who has ever read a basic investing book or taken a class on investing knows the importance of diversification. It is just as important to diversify the way you save as it is to diversify how you invest. Your savings should be divided into three categories we call the New Three-Legged Stool:

Leg One: Tax-Deferred Savings. This is the money you save pre-tax in a 401(k) or traditional IRA. Saving money in these accounts have immediate tax benefits usually in the form of deductibility. They also provide long-term tax benefits through tax-deferral of the earnings. Unfortunately the tax man must be paid when funds are withdrawn.

Leg Two: After-tax Savings. This is the money you save in a bank or brokerage account that has no tax preferred treatment. Funds are saved after tax and the earnings are taxed each year they are realized. The benefit to you is accessibility and preferred tax treatment when the funds are withdrawn. There is never a tax penalty to access the money.

Leg Three: Tax-Free Savings. The final leg is the Roth IRA and Roth 401(k). The Roth IRA has become a popular way to expand retirement investing for many investors because, although contributions are not tax deductible, Roth distributions can be tax free if certain conditions are met, and the owner is not required to take distributions at age 70?.

The goal is to balance your savings and investments into all three legs. This allows you to take advantage of some immediate tax benefits while putting money away in areas that will benefit your taxes in the future. This is the ultimate in tax efficiency. Too many people only save money in their tax deferred account because they get the current tax deduction. This is short sighted thinking because every dollar they try to spend from these savings will be subject to tax. Tax brackets may never be as low as they are today. A one sided savings plan that relies only on tax-deferred savings could find the owner paying taxes at a higher rate than while they were working.

Principle 7: Embrace the volatility of the stock market.

Most people do not like volatility. They equate volatility to risk and to a large extent, they are correct to do so. I?ve had people tell me they would rather have the relative certainty of a two-percent return from a certificate of deposit (CD) than invest in the stock market, where historic returns average close to 10 percent. Unfortunately, they ignore the fact that inflation has historically averaged nearly four percent. All they?ve guaranteed is a reduction in volatility, not the success of their financial future. Some investors frequently shift their money in and out of the stock market. They will get out when they fear a crash and get back in when they expect a boom. The problem with trying to time the market is that no one can consistently predict the short-term events that push the market up or down.

Investors may be better served to embrace the volatility of the stock market. It?s the volatility that produces the 10-percent-average return. If stock prices were stable, the returns may not be as high. The investing profession calls this a ?risk premium.? This simply means that if an investor is to put up with the volatility of his or her portfolio, that investor should be rewarded with a higher return (although there are no guarantees). It makes sense.

Principle 8: Diversify and rebalance to succeed.

Too many people assert that long term investing doesn?t work anymore. They point to the last 10 years and call it the lost decade ? a period when no money was made in the market. We believe that a successful long-term investment strategy should be based on broad diversification over all the asset classes with periodic rebalancing to take advantage of market volatility. Allocate your assets across the major asset classes ? stocks, bonds, and cash ? to help you pursue the optimal returns for the risk level you are willing to undertake. 'Old Spice Guy' makes muscles play music

Terry Crews mixes muscles and music with a new Old Spice video that lets users get a chance to play.

Watch out, "Old Spice Guy" Isaiah Mustafa. Terry Crews ? former NFL player and "Expendables" star? is muscling in on your success, playing music using his muscles?? yes, his muscles?? in an ad for the men's aftershave on Vimeo that has been played more than 1.7 million times in the last two days.

Not only does Crews use his muscles to trigger various instruments, but after the ad is over, viewers can use their own keyboards to control Crews' muscles and make their own "muscle-powered musical creations."

The clever "Muscle Music" ad campaign is by global ad agency Wieden + Kennedy. It first surfaced Aug. 23, but viewership has gone viral in the last 48 hours on Vimeo, where the after-show can be created.

"To promote the new Old Spice scent Danger Zone, Old Spice Muscleman Terry Crews does what no man has ever done before ? play a drum set using nothing but his flexing muscles," the ad agency says on its website.

"In addition to watching his historically important muscle powered performance, users also have the ability to use their keyboards to control Terry's muscles and create and share their own muscle-powered musical creations."

Or, as the firm noted on its blog:

Never has so much stupidity and technological breakthrough been combined into one thingy. It's the first ever fully interactive and sharable music video/player on Vimeo (or YouTube for that matter).

"Old Spice Muscle Music" also takes the marketing effort to Reddit, where Crews is taking questions from fans and viewers, for now.

Tokyo Gas Co., Ltd. today concluded with Malaysia LNG Sdn. Bhd., a Memorandum of Agreement to renew the LNG sale and purchase contract of Malaysia Dua project, which will expire on March 2015.

Tokyo Gas has procured LNG from the Project since 1995 under the current contract. Tokyo Gas has kept discussions to renew the contract with Malaysia LNG, and today reached a conclusion of a Memorandum of Agreement. With this agreement, Tokyo Gas will procure approximately 900 thousand tons of LNG per annum over a period of ten years starting from April 2015.

In accordance with this agreement, Tokyo Gas and Malaysia LNG will move forward with discussions to conclude a new LNG sale and purchase contract.

Tokyo Gas and Malaysia LNG have other LNG sale and purchase contracts, and have built a trust in relationship spanning approximately 30 years. This agreement will serve to maintain stable trade between Tokyo Gas and Malaysia LNG.

From here onwards, Tokyo Gas will work towards stable and competitive procurement of LNG.

Enlisting the AIDS virus to fight cancer

ScienceDaily (Aug. 28, 2012) ? Can HIV be transformed into a biotechnological tool for improving human health? According to a CNRS team at the Architecture et R?activit? de l'ARN (RNA Architecture and Reactivity) laboratory, the answer is yes. Taking advantage of the HIV replication machinery, the researchers have been able to select a specific mutant protein. Added to a culture of tumor cells in combination with an anticancer drug, this protein improves the effectiveness of the treatment at 1/300 the normal dosage levels.

Published in PLoS Genetics on 23 August 2012, these findings could lead to long-term therapeutic applications in the treatment of cancer and other pathologies.

The human immunodeficiency virus (HIV), which causes AIDS, uses human cell material to multiply, primarily by inserting its genetic material into the host cells' genome. The distinctive characteristic of HIV is that it mutates constantly, and consequently generates several mutant proteins (or variants) in the course of its successive multiplications. This phenomenon allows the virus to adapt to repeated environmental changes and resist the antiviral treatments that have been developed so far.

At the IBMC (Institut de Biologie Mol?culaire et Cellulaire) in Strasbourg, the researchers of the CNRS Architecture et R?activit? de l'ARN laboratory had the idea of using this multiplication strategy to rechannel the effects of the virus for therapeutic purposes, in particular the treatment of cancer.

They first altered the HIV genome by introducing a human gene that is found in all cells: the gene for deoxycytidine kinase (dCK), a protein that activates anticancer drugs (2). Researchers have been trying to produce a more effective form of dCK for several years. Through HIV multiplication, the CNRS team has selected a "library" of nearly 80 mutant proteins and tested them on tumor cells in the presence of an anticancer drug. The results have enabled them to identify a dCK variant that is more effective than the wild-type (non-mutated) protein, inducing the death of tumor cells in culture. In combination with this protein, the anticancer drugs showed identical effectiveness at 1/300 the dose. The possibility of reducing the doses of anticancer drugs would palliate the problems posed by their components' toxicity, reduce their side effects and, most importantly, improve their effectiveness.

One advantage of this experimental technique is that the mutant proteins were tested directly on cells in culture. The next step in the years to come will be preclinical (animal) studies on the isolated mutant protein. In addition, this experimental system using a normally life-threatening virus is likely to lead to a great many other therapeutic applications.

Short- and mid-term cardiovascular effects of Japan's 2011 earthquake and tsunami: Incidence rises with the seismic peak

ScienceDaily (Aug. 27, 2012) ? The Japanese earthquake and tsunami of 11 March 2011, which hit the north-east coast of Japan with a magnitude of 9.0 on the Richter scale, was one of the largest ocean-trench earthquakes ever recorded in Japan. The tsunami caused huge damage, including 15,861 dead and 3018 missing persons, and, as of 6 June 2012, 388,783 destroyed homes.

Following an investigation of the ambulance records made by doctors in the Miyagi prefecture, close to the epicentre of the earthquake and where the damage was greatest, cardiologist Dr Hiroaki Shimokawa and colleagues from the Tohoku University Graduate School of Medicine at Sendai, Japan, found that the weekly occurrence of five conditions -- heart failure, acute coronary syndrome (including unstable angina and acute MI), stroke, cardio-pulmonary arrest and pneumonia -- all increased sharply soon after the earthquake occurred.

Such reactions -- in ACS, stroke and pulmonary embolism -- have been reported before, said Dr Shimokawa, in Japan, China and the USA. However, these studies reported only the short-term occurrence of individual CVD events, and the mid-term CVD effects of such great earthquakes remain to be elucidated. To this end, the study examined all ambulance transport records in the Miyagi prefecture from 11 February to 30 June for each year from 2008 to 2011 (ie, four weeks before to 16 weeks after 11 March, a total of 124,152 records). Incidence records from before, during and after the earthquake disaster were compared, the aftershocks counted and recorded according to a seismic intensity of 1 or greater.

The number of aftershocks in the Miyagi prefecture was frequent during the six weeks after the earthquake, and the second peak was noted as a large aftershock on 7 April 2011 (magnitude of 7.0). Compared with the previous three years, the significant increases in the occurrence of heart failure and pneumonia were steadily prolonged for more than six weeks after the tsunami struck. On the other hand, the incident increases in stroke and cardio-pulmonary arrest followed the pattern of the first and aftershock seismic peaks. The rapid increases in the occurrence of acute coronary syndromes and cardio-pulmonary arrest was followed by a sharp and significant decline. Interestingly, said Dr Shimokawa, age, sex or residence area did not significantly affect the occurrences of CVD during or following the tsunami.

"To the best of our knowledge," he added, "this is the first report to describe the mid-term course of major cardiovascular events and pneumonia after a great earthquake in a large population. In particular, our findings provide the first evidence that the incidence of heart failure was markedly increased over a long period afterwards." Prevalence of pneumonia, a well known risk factor for deteriorating heart failure, was significantly increased.

The Tohoku University study also found -- as reflected in self-monitoring measurements -- that blood pressure was significantly elevated after the Earthquake. However, transport disruption following the tsunami interrupted delivery of regular medications, such as antihypertensive or antithrombotic drugs, and this may have contributed to the increased cardiovascular events. There was also an increase in the occurrences of ventricular tachyarrhythmias in patients with implantable cardiac defibrillators.

"Taken together," said Dr Shimokawa, "we consider that discontinuation of drugs, activated sympathetic nervous system, rising blood pressure, and the increased occurrence of tachyarrhythmia and infections were all involved in the increased occurrence of cardiovascular events after the Great Earthquake of Japan."

Crock Pot Sugared Pecans - Yes


We have this fabulous hunting, fishing, camping, gun,?etc outdoor store called Bass Pro Shop.? To a man, and maybe some women, this is a Disneyland type place to be. This place is so big, they also have big boats on the inside.?My husband and sons can get lost in there for hours, possibly days if I didn't pitch a fit. As for me, I wander through their outdoor kitchen supplies, their food supply area and their gift shop and candy store.? Oh yes, candy store.? There they make these fabulous sugared pecans, almonds and walnuts.? When you first enter the store, the smell leads you straight to heaven!? So though I'm not thrilled at spending hours there, I'll do my wee bit of browsing and then head over to pick up a nice hot bag of candied nuts and then I'll head over to the western furniture area, pick a couch and hang out until the boys are done. It's a nice little escape and a rest area plus I have no choice but to relax and dream away while eating little candied dreams, one at a time.? I am praying this recipe is a close copy cat and my home can be transformed into the place where dreams are made and smells are heavenly. Plus, this is made in a crock pot...can it get better than that?

You will need:
>16 ounces pecans or walnut halves
>1/2 cup melted unsalted butter
>1/2 cup powdered sugar
>1/4 teaspoon ground cloves
>1 1/2 teaspoons ground cinnamon
>1/4 teaspoon ground ginger

1. Turn slow cooker to HIGH about 15 minutes in advance. In hot slow cooker, stir together the nuts and butter.
2. Add the powdered sugar, stirring to blend and coat evenly. Cover and cook on HIGH for 15 minutes. Reduce the heat to LOW and remove lid; cook, uncovered, stirring occasionally, for about 2 to 3 hours, or until the nuts are coated with a crisp glaze.
3. Transfer the nuts to a bowl.
4. In another small bowl, combine the spices; sift over the nuts, stirring to coat evenly.
Let cool before serving.




So let's begin~
I gathered my ingredients.? I love it when a recipe only requires a few items and a crock pot, however when it comes to a crock pot, I love it more when it's a make it and forget about it.? I'm not keen on having to constantly pay attention to a crock pot, it defeats the purpose.
I mixed my butter and nuts in the crock pot.
I added the powdered sugar and stirred.? Then I put on the lid and continued the crock pot on high for 15 more minutes.

I took the lid off the crock pot and turned it onto low, stirring every so often.
I got my spices ready to sift onto the finished product.? Now I'm just waiting...salivating. I'm a little sad because I didn't realize that the spices don't get cooked, but just added onto the finished product.? I'm not smelling the fabulous smells like I was hoping I would.
After about?2 1/2?hours...not a lot of change. In fact, it had looked the same for over an hour in a half.? I decided to put it on high, stirring even more often.?? It was hours more of stirring before this even started glazing somewhat.
So forever later, I sifted the spices into the nuts.? It smelled like Christmas with the ginger coming through almost too strongly.

I was?pleasantly surprised.? They were pretty tasty, at their best while somewhat warm.? I wasn't thinking I'd like them because the smell was so very strong but it was quite tasty. My family alike really enjoyed these treats. It wasn't Bass Pro shops taste and?definitely not the same smell.? The one thing however I did not like was the cook time and the constant stirring.? This was almost more work than it was worth.? I would have preferred to cook it over the stove to just be done with it. Possibly you may be looking at a crock pot version because your stove is broken or you don't have one.? Maybe you are a teacher looking for easy non range things to do with kids.? Well, this may be right up your alley.? I am sure if I had 20 kids all taking turns stirring these nuts for 5 or so hours, I might not be so unhappy with the cook time. But the choice is yours.? Pakistan probes report US strike kills Haqqani son

KHAR, Pakistan (AP) ? Pakistan is investigating whether the son of the founder of the powerful Haqqani militant network, which has been blamed for high-profile attacks and kidnappings in Afghanistan, was killed in a U.S. drone strike this week, officials said Saturday.

If confirmed, the death of Badruddin Haqqani, who has been described as the network's day-to-day operations commander, would mark a major blow to the organization founded by his father, Jalaluddin Haqqani, and viewed by the U.S. as a powerful enemy in neighboring Afghanistan.

Two Pakistani intelligence officials said Saturday they are 90 percent certain Badruddin was killed Tuesday in North Waziristan in an American missile attack. They said their information was based on reports received from their agents in the field but acknowledged they haven't spoken to anyone who has seen the body.

A senior Taliban commander said a U.S. drone strike killed Badruddin. There was no independent confirmation, and the U.S. does not comment publicly on the controversial drone program, which is widely reviled by the Pakistani public and has been a source of tension with Islamabad.

All spoke on condition of anonymity due to the sensitivity of the news.

The areas where the American drone strikes generally occur are extremely remote and dangerous, making it difficult for reporters or others to verify a particular person's death.

Badruddin is considered a vital part of the Haqqani structure and is believed to have played an active role in kidnappings, extortion and high-profile operations in Afghanistan. He is believed to be the network's day-to-day operations commander, according to a report by the Institute for the Study of War.

Replacing him would be a challenge but not impossible, said Daniel Markey, a Pakistan expert at the Council on Foreign Relations.

"The question would be whether anyone would be as trusted, as well-placed, would have forged the kind of longstanding connections and would have the kind of pedigree that he has," said Markey. "This is a big hit if it's true but it's not going to put them out of business."

The U.S. State Department has designated Badruddin, along with his father and brothers ? Nasiruddin and Sirajuddin ? as terrorists. The State Department said in May 2011 that Badruddin sits on the Miram Shah Shura, a group that controls all Haqqani network activities and coordinates attacks in southeastern Afghanistan.

Badruddin is also believed to have been responsible for the 2008 kidnapping of New York Times reporter, David Rohde, the department said.

"During his captivity, Badruddin forced Rohde to make videos and write letters demanding money and a prisoner exchange as conditions for his release. Badruddin threatened Rohde's two Afghan companions in order to compel him to cooperate, and threatened to kill all three of them if his demands were not met," the State Department said.

After their father effectively retired in 2005, Badruddin and his brother Sirajuddin expanded the network into kidnapping and extortion, both highly profitable for the organization, according to a recent report by the West Point, N.Y.-based Combating Terrorism Center. Afghan intelligence authorities have released intercepts of Badruddin orchestrating an attack against the Intercontinental Hotel in Kabul in 2011, the CTC said.

The U.S. has long viewed the Haqqani network as one of the biggest threats to U.S. and NATO forces in Afghanistan as well as the country's long term stability. The group has shown little interest in negotiating with the Washington, and has pulled off some of the highest-profile and most complex attacks in Afghanistan, although not necessarily the most deadly.

The U.S. faults Islamabad for what it says is a failure to go after the group, which has essentially made its base in Pakistan's North Waziristan tribal region, which borders Afghanistan.

Pakistan has said its forces, which have been fighting an insurgency that has already cost more than 30,000 Pakistani lives, are overstretched and unable to launch an attack in North Waziristan. Recently U.S. Secretary of Defense Leon Panetta said Pakistani officials indicated that they would carry out an operation in North Waziristan soon but there has been no indication that a large-scale operation is in the offing.

It's unclear whether the U.S. received any assistance from the Pakistani military in tracking down Badruddin. If they had cooperated on the hit, it would mark a significant improvement in U.S.-Pakistan relations. The strike came the same week that NATO forces in Afghanistan killed a senior Pakistani Taliban commander operating in Afghanistan. Pakistan has long been pushing the U.S. and NATO to do more to combat Pakistani Taliban militants that it says use Afghanistan as a safe haven.

However, moving against the Haqqanis would be an about-face for Pakistan, which is believed to view its relationship with the network as important in helping shape Afghanistan after American and other international troops leave. Tomato, Brie and Herb Pasta ? The Runaway Spoon

I?ve been making this dish for years, decades if I?m honest.?I really thought it was my own unique creation, and?I patted myself on the back for its genius every time I made it.? It?s been my date night dinner, my decadent solo treat and my impressive meal for friends.? I made it in my first apartment kitchen and shared it with my first house roommate.? It dates, for me, to a time when anything with brie seemed sophisticated and gourmet, before I had stretched my culinary wings too far.? But I just realized, when developing it and photographing it for The Spoon, that it?s not my recipe.? It?s from the classic Silver Palate Cookbook, which I have had for years.? My favorite recipes in the book are marked and stained ? but oddly not this one. Oh, I?ve changed it up a little to suit my tastes, but it is definitely from the cookbook.? Recipes do that, they travel and share and move and become part of a family or a personal legend. I love looking through community cookbooks from different eras and different regions and finding the same basic recipe, maybe with a different name or spelling.? That?s one of the many magical aspects of cooking and feeding friends and family, the community built around good food.? And by the way, I also recently realized that I?ve been taking credit for Nigella Lawson?s lemon linguine for some time now too.

This really is the joy of summer in a delicious, creamy pasta dish.? And it?s quick to put together ? just a bit of chopping.? Sweet cherry tomatoes really shine in this dish, with the nice firm bite preserved.? The simple sauce smells wonderfully summery and the brie melts and coats the pasta, making a rich and decadent cream sauce without the work and kitchen heat.

Tomato, Brie and Herb Pasta

Adapted from The Silver Palate Cookbook

1 cup fresh basil leaves, loosely packed

? cup fresh oregano leaves, loosely packed

2 cloves garlic

1 pound cherry tomatoes

1 pound Brie

? cup olive oil

Salt and pepper

1 pound linguine or spaghetti

Finely chop the basil and oregano and place in a large bowl that will hold all the cooked pasta.? Put the garlic through a press, or finely chop it, sprinkling a little salt over it during the process.? This helps mellow the garlic, you don?t want big chunks.

Cut the tomatoes in quarters, or chop them smaller if you?d like, and add to the bowl.? Scrape the rind off the cheese ? you don?t have to be too precise about this, just do your best.? A serrated knife and cold cheese helps.? Cut the brie into small pieces, or pull it apart with your fingers, and add to the bowl.? Pour in the olive oil, add few good pinches of salt and grind in some fresh pepper.? Stir everything together, cover the bowl and leave at room temperature for a least an hour, but several hours is fine.? The tomatoes will release their juices and the cheese will become meltingly soft.

When you are ready to eat, bring a large pot of well salted water to a boil and cook the pasta according to the package directions until al dente.? Drain quickly, then pour the hot pasta over the sauce in the bowl.? Leave to sit for a few minutes to melt the cheese and heat the tomatoes through.? Toss the pasta and the sauce together until the pasta and tomatoes are well coated.? Salt and pepper to taste and serve immediately.

Elisabeth Murdoch denies she wants top News Corp job

EDINBURGH (Reuters) - Elisabeth Murdoch denied on Friday she wanted to succeed her father as head of the News Corp media empire, but acknowledged her role in forcing out one of his favorite newspaper executives over a phone hacking scandal.

Speaking at the Edinburgh Television Festival, she said that as a daughter it had been heartbreaking to see Rupert Murdoch humbled by the scandal which engulfed his News of the World newspaper, but played down her own ambitions.

"I really harbor absolutely no ambition for a top job (as head of News Corp)," she told a question and answer session.

Elisabeth Murdoch, who runs a television production company, cast herself as the moral face of the Murdoch children following a speech on Thursday evening when she took aim at her younger brother James.

Implicitly criticizing his handling of the scandal at the now defunct British newspaper, she said profit with no purpose was a "recipe for disaster", picking up on comments made by James who was once considered their father's heir.

Elisabeth said she had pressed for the resignation of her father's favorite UK director, Rebekah Brooks, during family talks on how to deal with the phone hacking affair which convulsed the Murdoch empire last year.

Asked whether she had urged James to stand back and had said Brooks should resign, Elisabeth said: "Yes."

"It was said within closed walls and Rebekah did resign. She had to resign."

Brooks, who oversaw Murdoch's British newspaper arm, has been charged with illegally intercepting voicemail messages and will appear in court on September 3.

Revelations that News of the World reporters hacked into the voicemails of celebrities, politicians and even a child murder victim caused uproar in Britain. News Corp had to halt a $12 billion bid to buy the rest of its British pay TV group BSkyB it did not already own, angering investors and sowing doubts as to whether James had what it took to run the $55 billion empire.

Rupert Murdoch, now aged 81, admitted to an inquiry into the scandal that he was experiencing "the most humbling day of my life".

Elisabeth, who had left the family business after being sidelined in favor of her younger siblings James and Lachlan more than a decade ago, said she had mixed feelings about her father's comment. "I was pleased he said that and I know he absolutely meant it, and if I am honest as a daughter it was heartbreaking," she said.

Some interpreted her public attempt to differentiate herself from her business executive brother James and to showcase her own views on News Corp development as a covert pitch for the top job.

"There's only one way to look at this," Murdoch biographer Michael Wolff told Reuters. "This is part of a strategic repositioning of Liz Murdoch within the media world, within the business world and within the family."

Elisabeth, 44, said she had given Thursday's speech to stand up and be counted, adding that she did not want everybody in the company "tarred or marked with the same brush".

The failure of the company to uncover and address the transgressions cost her brother James his job as chairman of News Group Newspapers and then as executive chairman of News Corp's newspaper arm, although the resignations were strung out as the scale of the failings were laid bare.

James has resigned as chairman of BSkyB and moved to New York.

FAMILY SOAP OPERA

Elisabeth said James had been the sibling focused on the path to the top. "I think the consensus was that James is an incredibly able executive and he is very much the one of us who had chosen to be within the company," she said.

She denied that they were fighting to follow in the footsteps of their father in a modern day soap opera equivalent of a court battle for the throne of the Murdoch empire.

"Everyone sort of likes the idea of the soap opera; the reality is really not that," she said. "It's more speculated upon than I think it merits."

She said that, along with her siblings, she cared passionately about the future of the company, but executive succession was up to the board.

Top managers drawn from beyond the family, such as chief operating officer Chase Carey, are viewed as the current front runners to take over from Rupert at News Corp.

Elisabeth was going to take a position on the News Corp board after the company bought her production company Shine last year, but did not do so as the crisis unfolded.

She had no plans to join the board "at the moment".

"I think and hope the family will be positive contributors even as shareholders in terms of the long-term interest of the company and the other shareholders, but that's really as far as I see it," she said.

Despite the nightmare of the last year, Elisabeth said the family remained close, and she was still "wholly inspired" by her father.

She described in the speech how Rupert had forged her values around the family table. On Friday she said he had also offered some less lofty but more practical career advice when she planned to study for a Master of Business Administration at Stanford University in the United States.

"'You don't need a fucking MBA,' he said. 'Go to Sky and learn about digital television'".

Sony Pictures Classics Picks Up Robert Redford's 'The Company You Keep' Starring Shia LaBeouf

Well, well, well -- things just got a bit more interesting for everyone figuring out their schedules for Venice and TIFF, as Sony Pictures Classics have put their stamp of quality on one of the higher profile acquisition films headed into the fall festival season.

Robert Redford's "The Company You Keep" has been snapped up by the arthouse outlet, marking a more mainstream effort from the shingle than we generally see. Directed by and also starring Redford, the film features a massive ensemble including?Shia LeBeouf, Julie Christie, Sam Elliott, Brendan Gleeson, Terence Howard, Richard Jenkins, Anna Kendrick, Brit Marling, Stanley Tucci, Nick Nolte, Chris Cooper, and Susan Sarandon,?in the Lem Dobbs (?Kafka,? ?The Limey," "Haywire?) penned story that follows a former Weather Underground militant Jim Grant (Redford), wanted by the FBI for a Bank Of Michigan robbery 30 years ago, who must go on the run when his true identity is exposed by a young, ambitious reporter (LaBeouf) hell-bent on making a name for himself.

The film makes its world premeriere at Venice shortly, will head to TIFF and we presume is a contendeder now to show up at Telluride. No release date yet, but if this bowls over critics, expect SPC to do some calendar shuffling.

Mayor Bloomberg Gives Press Conference at Empire State Building on Shooting

At about 11:21 a.m. on Friday Mayor Michael Bloomberg staged a press conference outside of the Empire State Building, to release information about the details of the tragic shooting that killed two people, including the gunman, and wounded at least eight others.

Bloomberg, who called the shooting a "terrible tragedy," emphasized that the shooting was the result of a workplace dispute between coworkers at a local business and had "nothing to do with terrorism."

Bloomberg, who arrived on the scene with Police Commissioner Ray Kelly, Chief Joe Esposito, and City Council Speaker Christine Quinn, identified the shooter for the first time as Manhattan resident Jeffrey Johnson, 53.

Johnson formerly designed women's accessories for Hazan Import Corporation, but was laid off last year, due to company downsizing. He returned to the business today, at 10 West 33rd Street, and then shot the manager in the head at close range with a 45 caliber handgun on the sidewalk at around 9 a.m.

Bloomberg revealed that the victim was 41 years old, but said that the police were withholding his identity until the victim's family had been notified.

After fleeing the scene, Johnson was followed by a local construction worker, who alerted two police officers who Bloomberg said were stationed nearby "on their usual counter terrorism assignments."

"As the two officers approached Johnson he pulled his 45 caliber semiautomatic pistol," said Bloomberg. "[They] returned fire killing him." Bloomberg clarified that it was unclear from the tape whether or not Johnson got off any bullets before he was shot, but that the footage clearly showed him pulling out his weapon.

At least 9 other people were also shot in the scuffle, 7 men and 2 women, and all are currently in the hospital. Some may have been accidentally by the police, but Bloomberg said there is "no expectation that any of them will do anything other than recover quickly."

Police Commissioner Kelly added that no children or elderly people had been shot. When asked about the gunman's background, Bloomberg said that he had did not appear to have a criminal record as far as they police had found, but he emphasized that they were only in the preliminary stages of an ongoing investigation.

"New York City is the safest big city," said Bloomberg in his statement, adding carefully, "but we are not immune to the national problem of gun violence." He went on to praise the "heroic" efforts of the police for responding immediately, adding that they were aided by a number of local civilians.

The area around empire state building remains an active crime scene, and will continue to be blocked off for the foreseeable future.
